LightSpeed Broadband Acceptable Use Policy
1. Introduction
1.1 This Acceptable Use Policy (the “Policy”) governs your use of the Services and Equipment provided by LightSpeed Broadband Limited (12487672), whose registered office is at Fulney Hall, Holbeach Road, Spalding, Lincolnshire PE12 6ER (referred to in this Policy as ‘LightSpeed’, ‘we’, or ‘us’).
1.2 This Policy forms part of your Agreement with us, which includes either the LightSpeed Residential Broadband Terms and Conditions or the LightSpeed Business Terms and Conditions (whichever is applicable to you). Both the LightSpeed Residential Broadband Terms and Conditions and the LightSpeed Business Terms and Conditions are referred to in this Policy as the “Conditions”. Where definitions are not included in this Policy, the definitions set out in the Conditions apply.
1.3 If you do not agree to this Policy, you must inform us immediately and we may stop or suspend providing you our Services and Equipment, in line with the Conditions.
2. Amendments to this policy
We may amend this Policy from time to time. Please check this Policy on our website on a regular basis to ensure you understand the most up to date Policy that applies at that time. This Policy was most recently updated on 18.06.24.
3. Restrictions on use
3.1 By entering into an Agreement with LightSpeed Broadband, you agree to the terms of this Policy and that you will comply with this Policy.
3.2 You are responsible for the use of your Services and Equipment by anyone who has access to them, regardless of whether they have your permission.
3.3 You are only permitted to use the Services and Equipment in accordance with the terms of our Agreement with you.
3.4 Where you are subject to the LightSpeed Residential Broadband Terms and Conditions, you agree that you will only use the Services and Equipment for legitimate private, personal and domestic reasons.
3.5 Where you are subject to the LightSpeed Business Broadband Terms and Conditions, you agree that you will only use the Services and Equipment for legitimate business reasons.
3.6 You agree to make us aware as soon as you believe that you or anyone else using your Services or Equipment may have done anything to breach this Policy.
3.7 You agree not to use the Services or Equipment nor permit them to be used in a way we deem to be unacceptable, this includes, but is not limited to, the Services and/or Equipment being used:
(a) in a way which impacts the performance of our Network or the quality of service that we provide to other customers;
(b) in a way which is disproportionately excessive to expected good faith:
(i) business use (if you are subject to the LightSpeed Business Broadband Terms and Conditions); or
(ii) domestic use (if you are subject to the LightSpeed Residential Broadband Terms and Conditions);
(c) maliciously, including the spreading of viruses, trojan horses, keystroke loggers, spyware, adware, spam and other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware and other security risks;
(d) fraudulently, including the use of any of our Services or Equipment with the intention to defraud another person or take advantage of them in any way;
(e) in a way which amounts to piracy, including any unauthorised use, reproduction, or distribution of any content without the appropriate permission;
(f) in any manner which alters or damages the Equipment;
(g) in any manner that disrupts the business, systems, equipment, operations, websites of us or any other person or entity (including any denial of service and similar attacks);
(h) in a way which is harmful to minors or any other person;
(i) to view, share, or collect any content that is deemed to be offensive to others;
(j) in a way that is unlawful, illegal or to the detriment of other users, or in any way that breaches any applicable local, national, or international law or regulation;
(k) in a way which damages our reputation or that of our partners;
(l) in a way which breaches third party rights (including any third-party intellectual property rights);
(m) in connection with any service, use or purpose where the failure of the Services or Equipment (or any part) may endanger the health or life of any person or cause damage or loss to any tangible property or the environment;
(n) to bully, insult, intimidate or humiliate any person; or
(o) to send or knowingly receive, upload, download, use or re-use any material which does not comply with this Policy.
3.8 You must not resell our Services or Equipment to others.
4. LINKING AND OTHER INTELLECTUAL PROPERTY MATTERS
4.1 As a condition of use of the Services and Equipment, you agree not to:
4.1.1 create a frame or any other browser or border environment around the content of the Services (or any part);
4.1.2 display any of the trade marks or logos used on the Services without our permission together with that of the owner of such trade marks or logos; or
4.1.3 use or trade marks, logos or trade names in any manner.
5. Breach of this policy
5.1 If we consider that a breach of this Policy has occurred, we may take such action as we deem appropriate.
5.2 Failure to comply with this Policy constitutes a material breach of the Conditions and where there is such a breach we reserve the right to take any of the following courses of action without notice:
(a) an immediate suspension of your use of the Services and Equipment;
(b) an immediate restriction of your use of the Services and Equipment;
(c) a full disconnection of your use of the Services and Equipment;
(d) termination of your Agreement;
(e) legal proceedings against you for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; or
(f) disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
5.3 We exclude our liability for all action we may take in response to breaches of this Policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

7. Disputes
7.1 Please note that the terms of this Policy, its subject matter and its formation are governed by English law. The courts of England and Wales will have exclusive jurisdiction.
